TERMS AND CONDITIONS
Cultured BV is dedicated to provide our customers with the best level of service possible. Please see below for any questions you may have or the ways in which we can assist you.
Once we have received your order we will send an electronic invoice to your e-mail address as a confirmation of your purchase. It is important that you enter the correct e-mail address when placing your order. We recommend saving this email in order to facilitate any contact with customer service you may have in the future. The order confirmation (receipt) also serves as guarantee of proof of purchase.
You may pay with either credit or debit cards. Mollie banking, PayPal & Stripes services manages all of our banking transactions. Cultured BV does not store any credit card numbers.
All sales prices mentioned on the site include taxes, exclusive of the shipping costs. The shipping costs are determined during the buying process and communicated to the user, subject to the type of product, the total amount of purchased products and the chosen shipping method by the user. The final price total is in Euro and explicitly and clearly stated before the user confirms its purchase. The published price only refers to the written description of the products. The matching pictures are used purely as illustrations and can contain elements that are not included in the price. Cultured BV has the right to change certain prices, including the shipping costs, at any moment whichever the motive, although there is an engagement to apply the published prices at the moment of the purchase by the user.
ORDERS NOT FULFILLED
Occasionally, we may have just sold an item which you ordered, and have not had time to take it off our site. We apologize for any disappointment, but we will reach you to see if you would like a substitution or just a cancellation. Additionally, we reserve the right to not fulfill any order of an item listed in error.
Every visible damage and/or qualitative impairment of a product or other problems with for example the delivery has to be reported immediately, with the risk of losing any right, to the customer service department at the following address email@example.com
Legal warranty (only for customers) Under the Act of September 21, 2004 of the customers ‘protection regarding sales of consumer goods, the customer has legal rights. Each article is subject to the legal warranty starting the date of purchase (if applicable delivery to) the first owner. Any commercial warranty leaves these rights without prejudice.
In order to invoke the warranty, the customers must be able to show a proof of purchase. For items that were purchased online and that were delivered to the customer’s given delivery address, the customer needs to contact the customer service department, (firstname.lastname@example.org), after which the customer will have to return the goods at his costs to Cultured BV. The repair of an item doesn’t give the right of reimbursement. Every default needs to be reported within a month of detection. After which, every right for free repair or exchange will be voided. The (commercial and/or legal) warranty is never valid on defaults that were created because of accidents, negligence, falls, abnormal or incorrect usage, use of the item for other purposes it is intended for, changes or modifications made to the item, hard-handed usage, bad maintenance. It’s also not applicable on items with a shorter lifespan. The warranty is non-transferable. As soon as your order is transmitted to us, we are no longer able to change the delivery address. Standard deliveries on Belgian holidays will take an extra workday. Our couriers generally deliver from Monday till Friday. (We don’t consider Saturday and Sunday to be workdays)
The conditions of this article are only valid for customers who have purchased products on the Site, www.bluenash.com: The customer has the right to communicate to Cultured BV that he renounces to the purchase, without payment of a penalty and without justification within the 14 days starting the day after the product was delivered. Except not on customize jewelry, they will not be returned. Customers, who wish to use their waiver right, have to contact the customer’s service within 14 days from the delivery and return the products at their expense to Cultured BV, Verlatstraat 23-25, 2000 Antwerp, Belgium. Warranty term: One year from the date of purchase. This warranty covers manufacturing defects on the jewel itself (stones or locks). All gift cards are valid for one year as from the date they are purchased. Other parts than the above are not covered by this warranty. To have replacement covered under this warranty performed, please use our contact form on the “contact us” page. In the e-mail you need to specify your name, address, order number and a detailed description of the issue. Finally, write ‘reclaim of purchase’ as subject of the e-mail or letter. Return shipping is not paid by Cultured BV.
If Cultured BV cannot find any defects described above, the product will be sent back to the customer. Note that repair/replacements will be charged in the following cases, even during the warranty term.
– Failure caused by improper use or carelessness (knocks, dents, crushing, broken crystal, etc.)
– Failure caused by unjustifiable repair or modification – Failure Caused by fire or water, or a natural disaster such as for example an earthquake
– Esthetical changes that occur during normal wear and tear and aging (minor scratches, etc.;)
– If the warranty is not submitted along with the jewel.
This warranty warrants that you can receive free replacement in accordance with the terms set forth herein and within the specified term, and shall not restrict any lawful right of the Customer
It is important that you as a customer carefully check your goods / products when you receive your shipment in order to verify that the products are not damaged and correct. If your product is damaged in transport, whether the damage is visible or hidden, you must report this as soon as possible to the carrier. If you receive your item and see that it is damaged or does not match the one you ordered, you shall also contact us within 14 days from receiving the product. Any complaints shall be made to our customer service through our contact form on the contact page. Please supply the order number and the reason for complaint and we will get back to you shortly. Same applies for returns. Defective products returned to Cultured BV should be treated as if they were faultless. It is in all types of returns extremely important that the product is packaged in such a way that it cannot be damaged during transit. Cultured BV has the right to replace defective goods with goods of the same model. If the item has been discontinued, the customer will receive a full refund. In the case that a returned product has no errors or faults, Cultured BV will send the product back to the customer.
This site’s content, including text, logos, images, graphics, data, and software, is the exclusive property of Cultured BV and is protected by all applicable laws. Photos and all other images may not be reproduced, transmitted or printed for any commercial purposes. The compilation of all-content on this site is the exclusive property of Cultured BV.
Cultured BV only assume responsibility for a shipment while the item(s) is/are in its possession. Upon delivery of the item to the shipping carrier of choice, the laws RPR Antwerp and regulations of the shipper become the regulating laws of the shipment. The risk of loss of the item passes to you upon delivery to the carrier. We will not be held responsible for lost or delayed shipments after delivery to the shipping. Cultured BV will not be held responsible or liable in any way for its choice of shipping carrier.
REPRODUCTION OR DUPLICATION
Cultured BV grants you access to use its site but prohibits downloading any content, information, images, logos, text, tags, or coding contained within the site. Doing so constitutes a violation of this site’s Terms and Conditions

www.bluenash.com is the sole owner of the information collected on this site. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. www.bluenash.com collects information from our users at several different points on the website.
INFORMATION THAT WE COLLECT FROM EVERY VISITOR
We collect anonymous cookie information about the site pages and items you view. SHIPPING COST AND TIME
The shipping time in Belgium is around 1 to 2 business days; if longer the customer will be alerted immediately. The shipping time for international depends on the country of destination. All deliveries are traceable. Cultured BV. APPLICABLE LAW – JURISDICTION The Belgian law is applicable, with exception of the Terms of the International Privacy law about applicable law and with the regulations of Rome on international sales agreements regarding goods. If eventual conflicts the courts of Antwerp (Belgium) are solely competent. These Terms and Conditions are not applicable to purchases through other points of distribution than the webshop Cultured BV www.bluenash.com.
